County Appeals COBA's Win in Supreme Court Decision Re: 207c Benefits

Dear COBA Members;

Yesterday COBA VP Dennis Maurus notified you that the Union earned a decisive win in Supreme Court regarding the "No Lost Time" case and the denial of 207c benefits.

We originally won the case in Arbitration the end of last year but the County moved to vacate that decision in Supreme Court. In Court the Judge ruled in our favor and denied the Countys' motion with very clear and unambiguous language.

In his previous email VP Maurus advised the following:

"Although the County/Department has 6 months to appeal the Supreme Court Judge's decision to the New York State Court of Appeals, the Union firmly believes that an action such as this would be a waste of time and taxpayer money and we have made this point implicitly clear to them. "  

Well guess what?

The County immediately appealed the Supreme Court Decision to the 2nd Circuit Court of Appeals. Apparently the County's Office of Labor Relations can't take no for an answer and has no problem wasting time, resources and taxpayers money.

Today, I notified Nassau's Office of Labor Relations and the County Executive's office of the absurdity of this appeal and, just as in every other case, we will fight them with every resource we have to its logical conclusion.  

The facts surrounding this case are clear. Dennis Maurus and our legal team did a great job in arguing those facts, and we are confident that any appeal will uphold our win(s) in this case.  

If Labor Relations (and I use that term loosely) comes to its senses or they are given any other direction from the County I will let you know immediately, but rest assured that we are fully prepared to continue the fight on this and all other issues affecting us as Correction Officers.
