Dear COBA Members:
A few months back, it came to our attention that numerous COBA members who are enrolled in NYS Pension Tiers 5 & 6 were inadvertently having pension deductions taken form their overtime wages that were beyond the State mandated caps. As you are aware, Tier 5 & 6 members have limits on the amount of overtime that could be reported and counted towards their pensions. With those limits being in place, all overtime earned past those mandated limits should not have any pension deductions taken from those overtime wages. On November 21st, we were notified by the Nassau County Comptroller's Office that repayment of these mistakenly deducted wages will be returned on a separate check that will be mailed to the member's home address that is on file with the Department. From what we have been told, these checks should arrive between December 2nd and December 13th. Attached below are links that pertain to Tier 5&6 Overtime limits.
