Proposed By-Law change - To have as an option the use of electronic voting applications

To have as an option the use of electronic voting applications for use in Board of Governors Elections (Article XI) and for Contract Ratification votes (Article XXIV).

ARTICLE XI

          NOMINATION AND ELECTION OF EXECUTIVEOFFICERS

                                                    (CONTINUED)

SECTION 5.) Elections will be conducted in one of two manners, to be determined by the Board of Governors. Provision (c) of this part, applicable to provision (a) only.

a.)               Use of a voting machine that is secured from the Nassau County Board of Elections, and supervised only by members of the Election Committee for on site in person voting. Or;

b.)               Use of an independent balloting agency to conduct all portions of the election via mail in ballot. If this method is chosen, ballots will be mailed to all eligible members no later than fifteen (15) days prior to the November Correction Officers Benevolent Association General Membership meeting.

c.)               Absentee Ballots will be made available to members who are in good standing and eligible to vote but are unavailable to report to the polling place for in person use of a voting machine on an election day. This to only include members who are on disability leave, maternity leave or any other pre-approved entitlement day. The production and content of the Absentee Ballots will be solely at the discretion of the Election Committee. Absentee Ballots will be available to eligible members no sooner than fifteen (15) business days prior to the Election, and shall be returned to the Secretary of the Association via certified mail no later than five (5) business days prior to the Election.

          d.) The use of an independent balloting company’s software system which allows voters to cast votes from anywhere through their browser, smartphone or other mobile device.

ARTICLE XXIV

     CONTRACT RATIFICATION

SECTION 1.) Upon completion of contract negotiations with the County of Nassau and before acceptance of same, the following procedures shall be adhered to:

Governors in its sole discretion shall conduct a contract ratification vote by obtaining a voting machine from the Nassau County Board of Elections for an (on-site) in person vote.

Governors in its sole discretion shall conduct a contract ratification vote by one of two ways.

1.) By obtaining a voting machine from the Nassau County Board of Elections for an (on-site) in person vote.

2.) By use of an electronic voting application that can be accessed by membership via a computer, cellphone, tablet or other electronic device. This manner would be consistent with the electronic voting application utilized in Article XI (Nomination and Election of executive Officers)
