NYS Court of Appeals Rejects COBA's Motion to Appeal Wage Freeze Lawsuit

COBA has been notified that the NYS Court of Appeals has rejected COBA's motion to further Appeal the Wage Freeze Lawsuit. The written decision has not been issued as yet so the reasoning for the denial is unknown at this time. This rejection applies to each of Nassau's other Unions as well.

This now means that the Appeals process in the State Courts has finally been exhausted. We did not expect the Court of Appeals to rule in our favor as we have advised you previously due to the unanimous decision of the lower Appellate Court.

We now begin the process of returning this case to Federal Court to decide the Constitutionality of the Wage Freeze. I have directed our Labor Attorneys to conference with the Attorneys of Nassau's other Labor Unions to coordinate our next steps and make sure everyone is on the same page.
