NIFA Update

A message from Brian Sullivan, President

Be advised that COBA's petition along with those of the other county unions on the NIFA case has been submitted to the Federal Court. On Friday December 30th, all briefs were submitted to Hon. Judge Wexler in the Federal Court for the Eastern District in Central Islip.

As of now the cases have not been consolidated into one, but since each union's case is similar in substance we anticipate the cases to all be combined. Since the case was heard in Federal Court previously we are unsure if Judge Wexler will set a date to hear additional testimony or if he will simply order a summary judgement based on the original complaint that hasn't changed. Time will tell.

We never anticipated a favorable judgment in State Court as discussed ad nauseam over the past few years. We always thought we'd get the fairest shake in Federal Court with regard to the basic Constitutional question.  

We're here now, so let's hope we get a favorable decision.
