COBA Wins at Arbitration Re: Computer Ops Seniority Case

December 28, 2021

Dear COBA Members;

COBA received a notice of Arbitration Victory dated 12/23/21 regarding our "Computer Operations Job Assignment Seniority Grievance".

In his decision, the Arbitrator ruled that the Department/County violated the Collective Bargaining Agreement, when it selected applicants who were less senior COBA members for jobs in the Computer Operations Unit over senior COBA members who possessed the essential ability and adaptability to do the job.

This is a major victory for COBA in our constant battle to enforce what has been contractually negotiated with regard to the Seniority rights of COBA members as pertaining to Job Postings.

Securing Seniority Rights are one of the cornerstones of any Union and are a constant battle front when municipalities attempt to hand pick people for preferred job assignments. Particularly when no prerequisites for such jobs have been recognized and negotiated with the Union.

In this case, the Arbitrator ordered that the 3 grievants be assigned to the Computer Operations Unit forthwith.

A great job was done presenting this case by our attorneys and VP Brian Doyle in this matter.

In Unity;

Brian Sullivan, COBA President
