Effective March 18, 2018, New York Civil Service Law was amended to state that public employees are entitled to four hours leave for any type of cancer screening. (NY Civil Service Law §159-b). NYS has eliminated the requirement that the screening be for breast cancer (NY Civil Service Law §159-b) and repealed the screening for prostate cancer (NY Civil Service Law §159-c). Therefore, by statute the employees are entitled to 4 hours of leave for any type of cancer screening. The employees may use any provider of their choosing to obtain leave for this cancer screening.
In addition, COBA has confirmed with the Department that pursuant to the Sheriff's COBA collective bargaining agreement, COBA employees are entitled to breast and prostate cancer screening if it is conducted at NUMC. Pursuant to Section 49 of the Collective bargaining agreement, COBA employees are entitled to four hours of leave for breast cancer screening and four hours of leave for prostate cancer only if it is conducted at NUMC. The employees must use NUMC as their provider to obtain leave for cancer screening pursuant to the collective bargaining agreement.
As always, Nassau County employees have received both the benefits of NY Civil Service Law §159-b and their collective bargaining agreements.
Medical Documentation must be provided to HR immediately upon return to duty.
